The last will and testament of Robert (2) Bathurst was made by him on December 7th 1857 and left all his estate to his fourth and last wife Sarah (nee Brown). It was witnessed by John Brown and John Barnes whose connections are unknown. He died on August 4th 1860 and the will was proved by his widow at the Court of Probate's Principal Registry on September 15th 1860. His effects were valued at under 200 pounds.

On the 15th day of September 1860 the Will of Robert Bathurst late of 3 Savills Buildings, Stepney Green in the County of Middlesex, Dyer, deceased, who died in the 4th day of August 1860 at 3 Essex Street, West Street, Globe Fields, Mile End in the County of Middlesex was proved in the Principal Registry of Her Majesty's Court of Probate, by the Oath of Sarah Bathurst of No 3 Essex Street aforesaid and Widow the Relict of the deceased the sole Executrix therein named she having been first sworn to administer.

Last Will and Testament

This is the last Will and Testament of me Robert Bathurst of No. 3 Savills Building of Stepney Green in the County of Middlesex, dyer. I direct that all my just debts and funeral and testamentary expenses be paid and discharged by my Executrix hereinafter named as soon as conveniently may be after my decease. I give and bequeath all my household furniture, plate, linen, china, books, pictures, wearing apparel and other effects and all sum and sums of money which may be out, owing or belonging to me at my decease or which may be invested in or upon stocks, funds or other securities and also all other my estate and effects whatsoever and whosoever both real and personal and whether in possession, reversion or expectant unto my dear wife Sarah Bathurst her executors, administrators and assigns absolutely to and for her and their own use and benefit and I nominate, constitute and appoint my said Wife sole Executrix of this my Will and I hereby revoke all former Wills by me at any time heretofore made and do declare this to be my last Will and Testament. In witness whereof I the said Robert Bathurst have to this my last Will and Testament set my hand the 7th day of December in the year of our Lord One thousand eight hundred and fifty 7.

Signed and declared by the said Robert Bathurst the testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other (all being present at the same time) have hereunto subscribed our names as witnesses.

Grant of Probate

In the Goods of Robert Bathurst deceased:

I John Brown of No. 1 Northern Cottages, Randell Row, Islington in the County of Middlesex, Brass Finisher, make oath that I am one of the subscribing witnesses to the last Will and Testament of the said Robert Bathurst late of No. 3 Savills Buildings, Stepney Green in the County of Middlesex, dyer, deceased, the said Will being now hereunto annexed bearing date the seventh day of December One thousand eight hundred and fifty seven and that the said Testator executed the said Will on the day of the date thereof by signing his name in the attestation clause thereto as the same now appears thereon in the presence of me and of John Barnes the other subscribing witness thereto, both of us being present at the same time, and we thereupon attested and subscribed the said Will in the presence of the said Testator. And I further make oath that I verily believe the said Testator in so signing his name in the attestation clause intended and considered the same as his final signature to his said Will.

John Brown - Sworn at my office No. 13 Wellington Street of London Bridge, Southwark in the County of Surrey on the tenth day of September One Thousand eight hundred and sixty. Before me Henry Simpson a London Commissioner to administer oaths in Chancery.

Proved at London 15th September 1860 by the oath of Sarah Bathurst widow the Relict the sole Executrix to whom Admon was granted.
